KSPR Law successfully obtained a significant victory on behalf of Patriot Builders, Inc., with the Rhode Island Superior Court remanding a Planning Board decision that had denied a proposed residential redevelopment project in North Providence.
Patriot Builders sought to transform a former industrial property into much-needed housing through Rhode Island’s adaptive reuse framework. The Town’s Planning Board rejected the application, asserting—without adequate support—that the project exceeded the scope of adaptive reuse.
On appeal, the Court agreed with Patriot Builders, finding that the Board failed to provide the required factual findings or apply the governing law. The decision underscores that municipal boards must base their rulings on clear legal standards and a well-supported record—not conclusory assertions.
The Court’s ruling sends the matter back to the Planning Board for a new, legally compliant review, giving Patriot Builders another opportunity to move forward with its development.
This outcome highlights KSPR Law’s strength in land use and zoning litigation, and its commitment to holding municipalities accountable when they fall short of legal requirements.
