Michael Kelly, Michael Resnick, and Sean Klammer received a very favorable decision from the Federal District Court in Massachusetts in regard to a lawsuit brought by KSPR Law against the Town of Saugus and its town manager for violating its client’s constitutional rights in seeking to obtain approvals for substantial development projects in that town, and the town manager Scott Crabtree’s demand that TB Holdings, the plaintiff in the case, give a $200,000 “grant” for its project to go forward in the approval process.
In response to the multi count complaint, the town surprisingly filed a counterclaim for abuse of process, alleging that the lawsuit was filed in an effort to circumvent the approval process by the town. In response, KSPR Law filed a special motion to dismiss pursuant to the Massachusetts anti-SLAPP statute.
After oral argument, Federal District Court Judge Julia E. Kobick granted KSPR Law’s motion to dismiss and invited KSPR Law to file a motion for the award of attorney’s fees, which will be assessed against the Town of Saugus. The case will now proceed on the claims asserted in the complaint.
