This Opinion in 1100 North Main, LLC v. Shoreby Hill Properties, Inc., where Michael A. Kelly, Esq. and Gregory S. Estabrooks, Esq. of KSPR Law represented the Appellee Shoreby Hill Properties, Inc., provides significant clarity for Rhode Island practitioners on the Rule 12(b)(6) standard, especially as relates to the Statute of Frauds. KSPR Law believes Shoreby Hill Properties is the first reported decision of the Rhode Island Supreme Court affirming the dismissal of a complaint at the Rule 12 stage based upon the Statute of Frauds, which requires a real estate contract to be “signed by the party to be charged” to be binding. This decisive Opinion highlights the strength of KSPR Law’s capabilities not only at the trial court level, but also on appeals to Rhode Island’s highest court when required.
