KSP successfully obtained the reversal of a stop work order issued by a local building official before the State Appeals Board relative to a major development project in the Town of Exeter. Our client is developing a horticultural operation to grow native tomatoes for the entire region and has already constructed a greenhouse in connection with the development. The Town’s Building Official took the position that the subject Greenhouse required a building permit to be constructed and issued a cease and desist letter to our client relative to its construction activities. KSP Law prevailed at the state agency level based on an exception to permit for fabric structures, including, those comprised of glass and metal, that are primarily used for horticultural and agricultural purposes.
