After moving for summary judgment in Rhode Island Superior Court, Jackson Parmenter of Kelly Souza & Parmenter, P.C. (KSP Law) and his team have secured a complete defense victory on behalf of its clients in a case involving over $5M in damages being sought by a plaintiff relative to the construction and remediation of a CVS site in Rhode Island.
The matter involved complex, multi-party construction litigation wherein KSP Law successfully argued that the Economic Loss Doctrine operated as a complete bar to both the plaintiff’s, and the primary defendants’, tort-based claims and derivative tort-based claims, respectively. The ruling by the Rhode Island Superior Court marked the first time that the economic loss doctrine had been successfully argued to bar derivative tort-based claims against third-party defendants in Rhode Island.
