Attorney Jackson Parmenter of KSP Law successfully reversed a decision by the Rhode Island Department of Heath requiring a plaintiff doctor complete a competence assessment program and fitness for duty evaluation as a condition of returning to the practice of medicine after signing an agreement to cease practice in 2009.
After hearing before the Rhode Island Supreme Court, the Court affirmed the Superior Court’s decision reversing the Department of Health’s actions. The Supreme Court agreed with the Superior Court finding that despite the more than ten-year gap in practice, the Department’s decision was nevertheless arbitrary, capricious and not supported by competent evidence.
After reversing the Department’s decision, KSP Law was successful in obtaining an award of attorneys’ fees for its client against the Department.
